These terms and conditions cover the services provided by the Association of Sound Designers to it's members

Service

Any services provided by the Association of Sound Designers to it's members are for the sole use of it's members. Members are required to uphold the membership structure and the privacy it provides to it's members to the highest degree. You may never use another's account without permission and must keep your password secure. When creating your account you must provide accurate and complete information. The ASD may change or modify the services, benefits and website functionalities at any time without notice. 

Payment of fees and duration of membership

All fees become due at the start of our financial year, September 1st annually. Fees are reviewed annually.  

Your membership of the ASD does not expire on September 1st, but your access to the website and other services is restricted until you renew your membership. When you renew your membership you will be invoiced for the full membership year from the previous 1st September until the following 1st September. If your membership fees have not been paid within 6 months of becoming due we will assume that you have terminated your membership of the ASD and your account will be deleted.

You will be notified by email when your fees are due and when your account is about to be deleted.

Payments will be processed using PayPal. Other forms of payment are only acceptable for businesses and organisations. Please contact us for more details. Payment will be taken on application, and will be refunded if your application is unsuccessful.

Your membership of the ASD will automatically renew each September 1st. If recurring payments have been set up on your account then you will be automatically charged or invoiced as appropriate. 

If after September 1st, your payment does not go through, or you have opted to manually renew your account but haven't, access to the website and other services is restricted until you complete your renewal. When you renew your membership you will be invoiced for the full membership year. If you have not responded to our emails and your membership fees have not been paid within 6 months of becoming due we will assume that you have terminated your membership of the ASD and your account will be deleted.

Privacy

Any information provided will be held securely and in accordance with the Data Protection Act 1998. Personal details will not normally be disclosed to third parties. In some circumstances however we may need to disclose personal details to a third party so that they can provide a service requested, or fulfil a request for information. Any information that we pass to a third party will be held securely by that party, in accordance with the Data Protection Act 1998, and used only to provide the services or information requested. There is a right to request a copy of personal details at any time to check the accuracy of the information held. 

Information Collected

The Association of Sound Designers website collects data submitted by it's members, which each member can choose to share with the public, other members or not at all, by clicking on their name then Privacy link in the top left of every page. This data is primarily used to form a directory of members for the use by other members and the public. Other information such as a history of payments to the Association of Sound Designers is kept for accounting and administrative purposes, and in the compilation of usage statistics. Your information is kept for the duration of membership plus six months afterwards to ease the potential renewal process.

Directory

The Association of Sound Designers intends to regularly publish a directory of members, including photos and biographies where possible. The Association of Sound Designers will approach its members to collect biographies, but where this is unsuccessful, it will use information from the public profile of a member.

Copyright

Content published on this website and through the other services the ASD provides is protected by copyright. Any reproduction, modification, creation or derivative works from or redistribution of the content is prohibited without permission.

The permission to reproduce copyright material does not extend to any material on this site which is identified as being obtained from a third party. Authorisation to reproduce such material would need to be obtained from the copyright holders concerned.

The ASD does not claim ownership of content that its users post. However by posting content to be displayed on the website or through any other services the ASD provides, you automaticlly grant, and represent that you have the right to grant, to the ASD an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, display and distribute said content and to prepare derivative works of, or incorporate into other works, said content, and to grant and authorise sublicences of the foregoing - unless such content is otherwise labelled on posting.

If you wish to complain about material on this site because you believe there is a breach of copyright, the ASD will investigate promptly. Complaints should be directed to admin@associationofsounddesigners.com

Disclaimer

Every care has been taken in the compilation of the information on this site to ensure that all information is up-to-date and accurate. The Association of Sound Designers accepts no liability in connection with any loss, damage or inconvenience arising as a consequence of any use of, or the inability to use any information on this site. Information contained on this site does not constitute legal or other professional advice.

You agree to defend, indemnify and hold harmless the ASD, officers, directors, trustees, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expeses arising from your membership of the ASD, your violation of any third party right; or any claim that your actions caused damage to a third party.

Third Party Services

The ASD offers additional benefits to it's members via offers from third-party vendors. These third-party services are offered subject to terms and conditions from the thirdy party, and are subject to withdrawl at any time without notice. Availability of services may be subject to a minimum level of interest being shown, or to a maximum level of uptake. No reduction in member fees are available if third-party services become unavailable or are not as described. You are solely responsible for your dealings with third-party vendors, including the provision of any goods, services and financial transactions. 

The Association of Sound Designers cannot be held responsible for third-party benefits and services, nor does it have any control over them. All queries relating to them should be addressed to the vendor. 

Your interactions with organisations and/or individuals found on or through the services that the ASD offers are solely between you and such organisations and/or individuals, and the ASD shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings 

Termination of service

You may terminate your subscription at any time with the ASD with no less than thirty days notice. 

The ASD has the right to suspend your membership or block access to certain parts of the services provided immediately and without notice for any reason, including, without limitation, if your use of the services provided are inconsistent with the letter or spirit of the terms and conditions of use. Further, you agree that the ASD shall not be liable to you or any third party for any termination of your access to the services. 

Should your membership be terminated, a proportion of any fees paid may be refunded at the discretion of the ASD 

Amendments

The ASD may change, modify, add or remove portions of these terms and conditions at any times. Such changes will be announced on the website. Your continued use of the services following notice of such change indicates agreement to and acceptance of the terms and conditions as amended. If you do not agree to the changes of the terms and conditions then you must cease using the services and notify the ASD thay you are terminating your membership within thirty days.
